Any foreigner who presents himself to the French borders must be provided with a passport delivered in his country and with the documents and visas required by international conventions and the payments in force. He must, moreover, being able to present the lawful documents in proof relating to the object of the stay, the means of existence and the conditions of lodging.
The visa is a document bringing the proof that an authorization to enter the country was given to the applicant. It is delivered by the consulate of France in the country of origin. It is a method of control of immigration.
The people originating in certain countries do not need visa to come to France. They are the 25 countries of the European Union or other countries of Economic space European (Iceland, Liechtenstein, Norway), Andorra, Monaco and Switzerland.
Short term or tourism visa
It is delivered for the one duration stays of less than 3 months, it gives an import duty and a right of abode in France. It can be valid for one or more entries and it can be delivered for tourist reasons, deprived, family or professional. Caution: it is impossible to regularize its situation once in France simply provided with a visa of short stay.
The visa of long temporary stay

Long stay visa

VISABIO
The decree n° 2007-1560 of November 2nd, 2007, taken pursuant to the article L 611-6 of the Code of the entry and the stay from abroad and the right of asylum, creates data file new, named “VISABIO”.
The data, in personal matter, recorded in this treatment are in particular the digitized images of the photography and the digital fingerprints of the ten fingers of the applicants of visas. These data are collected, without the foreigner not being able to it to be opposed, by the consulates, the services in charge of the frontier check or, when they are brought to inform a request of visa, by the prefectural services.
Various categories of residence permits
- the residence permit temporary, valid for one year maximum duration renewable (except exceptions),
- the residence permit “competences and talents”, valid for one 3 years renewable duration,
- the resident's card, valid for one 10 years renewable duration,
- the residence permit “reprocessed”, valid for one 10 years renewable duration.
The temporary residence permit
It is a residence permit which makes it possible to remain in France. It is one year maximum duration. It is possible to obtain the renewal of a “student” title or “scientist” for a duration of 1 to 4 years. It can be marked various, according to the situation and of the object of the stay to France of the applicant. This chart can be marked “visitor” for holidays, “employed" if the applicant obtained the authorization to carry on an activity paid or the mention “private life and family”, if it justifies in France of personal and family fasteners.
Its period of validity cannot exceed the duration being reproduced on the passport.
The resident's card
The resident's card is automatically a valid 10 years and renewable residence permit. It makes it possible to follow the occupation of its choice on the whole of the French territory. It is at the same time a residence permit and a title of work. You must meet the 3 following conditions:
- not to constitute a threat for the law and order;
- you must be in regular situation when you ask for the resident's card;
- you cannot obtain the resident's card if you live in polygamy.
The resident's card is delivered automatically abroad which meets the conditions of acquisition of French nationality at a rate of its birth in France. It must reside in France and to have had its main home in France during at least 5 years (continuous or discontinuous) since the 11 years age.
Discretionary delivery
It can be to you delivered if you justify of a continuous and regular residence in France of at least 5 years and if you have an health insurance. The administration also takes into account the means of existence among which your community activity, family ties in France, the purchase of an apartment, the schooling of the children…
The resources must reach the SMIC at least, without taking into account the family allowances.

Full delivery
The chart is delivered in the following cases:
- foreign child of French, if this child has less than 21 years or is with the load of his parents;
- ascending foreigner of French and sound unites foreign, with his load, subject presenting a visa long stay corresponding;
- titular foreigner of a revenue of industrial accident or occupational disease poured by a French organization and whose rate of permanent disability is equal or higher than 20%;
- beneficiary from profit abroad of a revenue of death for industrial accident or occupational disease poured by a French organization;
- foreigner having been useful in a combat unit of the French Army;
- foreigner having been useful in a combat unit of a allied army;
- foreigner having been useful in the Foreign legion, counting at least 3 years of service in the French Army, and titular of the certificate of good behaviour;
- the foreigner having obtained the statute of refugee; in the same way of joint sound and his/her children, in the year which follows to them 18th birthday or minors, if the marriage is former to this obtaining, or failing this, if the marriage has been celebrated for at least a year, subject to a community of effective life between the husbands;
- justifying stateless person 3 years of regular residence in France as its spouse and his children in the year which follows to them 18th birthday or minors.
The residence permit “reprocessed”
The residence permit “reprocessed” makes it possible its holder to constantly enter to France to accomplish there stays one duration maximum one year. The title does not allow the exercise of an community activity. To obtain this chart, you must meet the 3 following conditions:
- to have resided in France under cover of a resident's card,
- to have established or to establish its main home out of France,
- to be titular of a contributively pension of old age liquidated under a French basic mode of social security.
The chart ranking “reprocessed” is automatically valid 10 years and renewable. The spouse can ask for a chart “joint of reprocessed” conferring the same rights to him, if it resided regularly in France with him.
The provisional authorization of stay (APS)
It is about a residence permit which enables you to remain in France regularly during its period of validity. It will be delivered to you:
- if you request the political asylum in waiting of the decision of the OFPRA;
- for care;
- for first track records;
- voluntaries;
- relative of a sick minor.
Its duration is variable. It seldom exceeds 6 months. The authorization can be renewed.
For the students, the duration is 6 months, without possible renewal.
Foreign students
The foreign student who wishes to follow higher learning to France must hold a temporary residence permit being marked “student”. This chart is granted subject to the detention of a visa long stay (except exceptions) and of sufficient means of existence. The period of validity of the temporary residence permit is limited to the validity of the passport; it cannot exceed the duration of the studies, teaching or the followed training course; its maximum duration is one year. It can be renewed. During the renewal of the residence permit, the serious one in the achievement of the studies is an important component of appreciation of the prefect. The student is judged on the results of the examinations to which it must have taken part.
The student who enters to France provided with a visa of long stay being worth temporary authorization of stay, one duration higher than 3 months and lower or equal to 6 months, is not subjected to the obligation to hold a chart.
Control on arrival

There exist exemptions for:
- stay in humane matter or lying within the scope of an cultural exchange;
- if the stay is justified by an urgent medical cause or funerals of a close relation.
Schengen Space
The convention of Schengen envisages the suppression of the identity checks at the borders between the countries signatories. The citizens who have a visa of long life for one of the Member States can circulate freely inside the zone. The principle of the freedom of circulation of the person implies that any individual (national of the EU or a third country), once entered on the territory of the one of the Member States, can cross the borders of the other countries without undergoing controls. To move, it does not need more passport and the flights between destinations of Schengen space are regarded as interior flights.
The following countries belong to Schengen Space:
Germany, Austria, Belgium, Denmark, Spain, Finland, France, Greece, Iceland, Italy, Luxembourg, Norway, Netherlands, Portugal, Sweden.
A State can restore controls in the event of attack with the law and order or the national security and after consultation of the other Member States.
