From the January 1st, 2007, the contract of reception and integration (CAI) is obligatory for the foreigners (amenable extra-community) allowed in France, for the first time, for a durable installation. The law of July 24th, 2006 relating to immigration and integration made compulsory the signature of the contract of reception and integration implemented by the ANAEM. The decree n° 2006-1791 of December 23rd, 2006 specifies the lawful methods of the CAI and the control of French knowledge from abroad.
The contract of reception and integration (CAI)
The contract of reception and integration is from now on obligatory. It makes it possible to the signatories to profit from formations intended to support their linguistic training and their integration in the French company.
This contract is addressed to any foreigner authorized to settle durably in France. It is made up:
- of a common standard contract comprising reciprocal engagements (to respect the laws and the values of France) and to follow the civic formation for the new arrivals, to organize the access to the individual rights and the training of the language;
- of an appendix personalized by which the new arrival begins to follow the formations prescribed within the framework of the contract.
The contract is concluded for one duration from one year, renewable once, if necessary as from the date of signature, at the request of the interested party.
The contract of reception and integration is translated in 14 languages.
The reception from abroad
The new arrivals take part in a meeting of collective information of presentation of the life in France and contract of reception and integration animated by a social listener of the ANAEM (National agency of the reception from abroad and migrations). A 16 minute old film their is projected presenting the life in France.
The session of information makes it possible to better know the steps of the daily life and to better include/understand the French company and the access to the public services (health, school, public service of employment, housing).
Each new arrival has a maintenance personalized with the social listener who aims at:
- to present the contract of reception and integration to the new arrival and to ask him to sign it;
- to locate its linguistic needs and to direct it;
- to inform it on the various steps to be undertaken;
- to propose to him, if necessary, a discussion with an assistant of specialized social service;
- to establish a personalized diagnosis of its needs.
During maintenance, if the French level is not sufficient, the migrant will be compels to follow a formation intended for the training of the French language sanctioned by an examination.
The new arrival also passes an obligatory medical visit if it did not do it in its country of origin.
At the conclusion of this meeting of reception, the foreigner sees himself giving an appointment to withdraw his residence permit to the prefecture.
Who is concerned with the CAI?
The contract is proposed to foreigners authorized to settle durably in France, in particular with:
- united and children from abroad authorized to reside in France who arrive within the framework of the procedure of family gathering,
- foreign members families of French,
- foreigners from 16 to 18 years,
- statutory refugees and their families,
- profit people of a temporary residence permit to the title of subsidiary protection,
- profit people of a residence permit “competences and talents”, “professions artistic and cultural”, “scientific”,
- people authorized to remain in France because of personal and family bonds,
- permanent workers.
Are exempted to sign the contract of reception and integration:
- people having carried out their schooling in an establishment of French secondary education abroad during at least three years,
- old foreigners from 16 to 18 years, born and resident in France, which meet the conditions to obtain French nationality and automatically to profit, for this reason, of a resident's card.
Linguistic and civic formation
The linguistic formation suggested with the new arrivals enables them to acquire basic written and oral competences. The formations, one 400 hours maximum duration, are financed by the ANAEM and lead to the making of the initial diploma of French language (DILF).
“Obtaining the diploma attests satisfying level of control of the French language envisaged by the L.311-9 article”.
The law of November 26th, 2003 relating to the control of immigration, the stay from abroad in France and nationality, integrates in article 21.24 of the Civil code, the obligation, for the applicants with French nationality, to have a “sufficient knowledge, according to its condition, of the French language and the rights and duties conferred by French nationality”.
The civic formation is free (financed by the State) and obligatory for all the signatories of the contract. This one day formation makes it possible to inform the new arrivals on:
- values and great principles of the French Republic: freedom, equality, fraternity/solidarity, secularity, the obligatory and free access to education;
- the organization and the operation of the State and the local government agencies and territorial;
- the access to French nationality and citizenship.
This formation is represented in the principal languages of the countries of origin.
The efforts made to make a success of integration in France will be taken into account at the time of the request for delivery of the resident's card or acquisition of French nationality.
The assiduity from abroad is attested by a registered certificate at the conclusion of the formation.
If the foreigner does not take part or more in the prescribed formations, without legitimate reason, the prefect can put an end to the contract for:
- to refuse the first renewal of the residence permit,
- to refuse the delivery of the resident's card (10 years).
